It looks like the “Winklevi” got the memo; party’s over folks.
Finally, the two brothers are calling an end to the Facebook lawsuit and taking the hint that the Supreme Court is unlikely to review their Ninth Circuit Court of Appeals case, which was rendered in San Francisco earlier this year.
At least that’s what they said in a filing at the Ninth Circuit Court of Appeals this week, reports Reuters.
Of course, we all know what happened next. Zuckerberg created The Facebook (which eventually because just “Facebook”) and the three fellow Harvardians sued, claiming that Zuckerberg stole their idea.
Then, when the lawsuit settled, they marched right back to court. This time, it wasn’t on the intellectual property claims but rather, on the idea that Facebook misrepresented information, therefore misleading Winklevi, et. al., into believing the stated worth of the shares that they got in the settlement.
The last time we left off with these guys, they were on the receving end of some harsh words from Judge Kozinski. At that time, their lawyers stated that the Winklevi were marching up to SCOTUS with their argument.
Several weeks later, it looks like the boys are heeding Judge Kozinzki’s warnings and backing down.
So for now, let’s assume that the Facebook lawsuit is over.
Or so it seems …
