9. Supreme Court Grants Cert in Aereo and Argentina Cases

In a mostly unexciting term, the Supreme Court granted cert. in two Second Circuit cases that had a surprising amount of appeal. Argentina’s financial future was at stake in one case, while an industry-disrupting startup fought for survival in the other.

One artist took another artist’s photographs and “transformed” them into paintings and collages. Fair use or infringement? This was one of the closest cases we’ve ever seen.

7. Half-Uncle’s Marriage to Half-Niece Not Incestuous: N.Y. Court

Speaking of close cases, where is the line between incest and merely a wee bit icky?

6. 9/11 Anniversary: What Happened to All Those Lawsuits?

On the 13th anniversary of one of the greatest tragedies in our nation’s history, a fellow blogger took a look at where some of the more notable litigation battles from that day have ended up.

Care to guess how this post that you’re currently reading was put together? A whole lot of copy-and-paste. The Second Circuit apparently does the same thing – except they were pasting bad law into nonprecedential opinions … again.

1. Basic Contract Principles Apply to CERCLA Subcontractor’s Claim

It’s a dispute about payment for environmental cleanup work between contractors and subcontractors. Other than the CERCLA part, this is a run-of-the-mill contract case.
